Content Removal Policy

III. Reporting of Content Violations

The Site encourages users to report any content that they believe violates our content guidelines. To submit a complaint, please follow these steps:

  1. Ways to report:
    • As a logged-in user, you can flag any content using the flag symbol.
    • Fill out the online help form, which can be found on the Site by clicking the blue (?) or Help button.
  2. Description: Provide a detailed description of the violating content, including the URL or any other relevant information.
  3. Reason: Specify the reason why you believe the content violates our content guidelines or terms & conditions.
IV. Processing and Response to Complaints

The Site will process all complaints within seven (7) business days. We may request additional information from the reporting user to facilitate a thorough investigation. 

V. Content Removal Criteria

The following types of content will be removed from the Site:

  1.  Content that promotes or glorifies illegal activities, such as child pornography, explicit violence, or criminal activity.
  2.  Hateful or discriminatory content that targets individuals or groups based on race, ethnicity, religion, gender, sexual orientation, age, disability, or any other protected characteristic.
  3.  Copyright infringement – content that violates the intellectual property rights of others.
  4.  Harassment or bullying content that targets individuals with abusive language, threats, or intimidation.
VI. Removal Procedure

When removing content, we will follow these steps:

  1. Immediate removal: The offending content will be removed from the Site immediately.
  2. Notification: We will notify the user who uploaded the content and provide a reason for the removal.
  3. Account suspension: The user’s account may be suspended or terminated depending on the severity of the violation.
VII. Exceptions

In exceptional circumstances, we may choose not to remove content if:

  1. It is deemed to have merit for artistic, educational, or research purposes.
  2. We have obtained the consent of all parties involved in the content.
  3. The content is intended to promote social awareness, advocacy, or public education on a specific issue.
VIII. Dispute Resolution through FairClaims (For Depicted Persons Only)

If a person depicted in the content disputes its presence on the Site, they have the option to seek a neutral resolution through FairClaims, an online dispute resolution service, as the next level of appeal after a final decision by the Site operator. During this dispute resolution process, the disputed content will be temporarily hidden from the Site until a resolution is reached.

  • Final Decision by Site Operator: If the Site operator has reviewed the complaint and reached a final decision, and the depicted person disagrees with this outcome, they may initiate the FairClaims process.
  • Content Hidden During Dispute: Once a dispute is submitted to FairClaims, the content in question will remain hidden and inaccessible to users on the Site until the dispute is fully resolved.
  • Neutral and Impartial Review: FairClaims provides a structured, impartial process for addressing concerns over consent or the nature of the content’s publication, ensuring that both the depicted person and the Site operator have an opportunity to present their case fairly.

This process helps ensure fairness and protects the rights of individuals depicted in the content.

IX. Mastercard/Visa Compliance

The Site will comply with Mastercard and Visa’s rules and regulations regarding online payment processing and card-not-present transactions. Specifically, we will ensure that our content removal policies align with Mastercard and Visa’s guidelines on acceptable content for online transactions.

X. Review and Revision

This Policy will be reviewed and revised as necessary to ensure compliance with changing regulatory requirements and community expectations. We may also update this Policy to reflect changes in our Site’s functionality or user behavior.

By using the Site, users acknowledge that they have read, understood, and agreed to abide by this Content Removal Policy. Failure to comply with this Policy may result in account suspension or termination.
